1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the SPEQ product, which includes the marketing website at getspeq.com (the "Site") and the SPEQ application available to authenticated users (the "App") (together, the "Services"), all operated by WesLan, LLC, a Delaware limited liability company ("WesLan," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. The Services
The Site provides informational content (including the SPEQ Build Log blog) and a waitlist. The App is the SPEQ application, currently in limited release, which lets authenticated users work with software specifications and related product artifacts. The SPEQ product is under active development; features, availability, and access policies may change at any time. Joining the waitlist does not grant you access to the App, and we make no promises about whether, when, or on what terms access will be made available to any particular person.
3. Eligibility
You must be at least 13 years old to use the Services. If you are under 16 and live in a jurisdiction that requires parental consent for the processing of your personal data (such as the EEA or UK), you must have your parent or guardian's permission before submitting your email address or creating an account.
4. Accounts, Waitlist, and Communications
To use the App you must create an account through our authentication provider (Clerk). You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly at support@getspeq.com if you believe your account has been compromised.
By submitting your email address through the waitlist, the blog subscribe forms, or the App sign-up flow, you consent to receive related email communications from WesLan, including service messages, announcements, launch news, and occasional product updates. You may unsubscribe from marketing emails at any time by using the unsubscribe link in any email or by emailing support@getspeq.com; transactional emails (such as account verification and password resets) are part of the Service and cannot be disabled while your account is active.
5. Acceptable Use
You agree not to:
- Use automated means (scrapers, bots, crawlers other than standard search-engine indexers) to access the Services.
- Attempt to reverse engineer, decompile, or extract the source of any software delivered through the Services.
- Interfere with or disrupt the Services, their servers, or connected networks.
- Use the Services to transmit unlawful, infringing, harassing, or harmful content.
- Submit another person's email address or impersonate another person when creating an account.
- Circumvent access controls, usage limits, or security measures of the App.
6. Intellectual Property
All content on the Services — including text, graphics, logos, the "SPEQ" name and mark, and the design of the Site and App — is owned by WesLan, LLC or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-commercial, non-transferable license to access and use the Services. No other rights are granted by implication. You retain ownership of the content you enter into the App and grant WesLan a limited license to host, process, and display that content as needed to provide the Services to you.
7. Third-Party Services
The Services rely on third-party providers, including Cloudflare (hosting and edge compute), Mixpanel (marketing analytics), SendPulse (marketing email), Clerk (authentication for the App), and Resend (transactional email for the App). Your use of the Services is also subject to the terms and privacy practices of those providers, to the extent applicable.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WesLan, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to indemnify and hold harmless WesLan, LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
